  • lawyers advice when police stop/arriest you...

    a post on the internet told of a man who was pulled off a public bus by the police, because he was watching a Ruger video and it offended another bus rider.

    i taught my kids to be mr. civilian anytime they are questioned by the police, as compared to mr. jerk.

    one of my kids recently sent this video of an atty giving advice about what to say. his point is that you should say nothing. that what you say can be twisted.



    i think i will alter my instructions.

    to the law enforcement guys on here... i'd like to hear your comments.

    Be pleasant, talk, but talk about NOTHING. :) Stick both hands out the window and keep them there while they approach, move slow and tell them what you are going to do if you have to get insurance cards, registration, etc.

    As a kid, I hung out with some people who rarely did anything that crazy, but evidently LOOKED like nefarious characters. Needless to say they were stupid enough to smart arse/get combative with "five O" every time they encountered them. I watched more than a few of them get slammed onto cruiser tops, on the ground, put in the car, handcuffed. Not a one were committing a crime before/while this happened. They just couldn't keep their damn mouth shut.

    On the other hand, doing the "only name rank and serial number" routine will likely make you stand out also.

    Most cops could give a crap about you prosleyatizing about "your rights", showing your CCW card, etc. Just shut up and if need be, lie. Better to have to repent of a lie than pay for a lawyer.

    Didn't watch the video so I don't know what they said.

        I watch that video about once every two years as a refresher on how to behave when being investigated.

          "Am I being detained? Am I free to go?" As you try to politely walk. If you are arrested, shutup and call a lawyer.

          What you say may be used against you in a court of law, not for you. So say nothing if you feel you are being unjustly questioned.

          On the other hand, realize these are people trying to do their job with limited information. Be polite and nice but don't dig yourself into a hole and especially don't tell a lie. If you become uncomfortable ask if you are free to go and leave. You are not obligated to tell anything. The matter of if you are correct or not will be taken care of in the court, so prepare for that (not the arresting officer).

          Just my $.02 worth half a penny. I'm not a lawyer and I've never been arrested, detained, questioned past a speeding ticket.

            I keep my lawyers card in my wallet , its great . When I hand my I.D. over I hand it also . On the back it explains my rights and if they have any further question to please contact him asap and unless Im being arrested , please write your citation quickly and clearly .

              being honest has always worked for me. except once.
              my last ticket i got went like this( state trooper)
              "protus know you were speeding right."
              me- no..honestly,if you say i was i was,,i just zoned out,,window down radio up,,2 lane road,,no traffic...how fast was i going anyway...
              trooper- 75 in a 60....
              me- dammmm..red handed i guess...(lic/ins etc handed over)
              trooper- where you going(i was 100 miles from home)
              me- to xyz festival...figure to see what it was about...
              trooper- well heres your 150$ warning ...dont zone out again,,and enjoy the festival..
              me- thank you sir,,be safe, and have a great day,,

              its worked on 4 other cops the last 10 yrs...

              me after not pulling over for an unmarked in a tricked out gt mustang and actually going faster to pull away from the car ( no lights at 1st)..

              two leos guns out etc..
              "hands on t he wheel.. etc etc etc

              i get told to get out walk backwards etc..me being the smart butt i put my hands up stage couch robbery style,,which they didnt like,,..then i get asked if i have any weapons on me..as im beiung patted down,,i say my pocket knife,, as i reach for it...hey look the back of my car met my face..after that they asked if i had any weapons in my car..
              " not really,,just a grenade,an rpg and a ak47.."
              that went over real well to.

              i walked away from that one with a warning since they did in fact tail gate me,push me to take off and they were doing that because a robbery just happened with a car similar to mine,,,

              last time i smarted off to the cops though LOL

                I can't speak for anyone else, but I had a lot of people talk me into giving them a ticket, when a warning would have probably been what they were going to get when I got out of the car. Being polite will get you a lot further than being a jerk.

                Like Protus, I was pulled over late one night by multiple police cars with guns drawn. I was an officer at the time, but out of state and in my POV. I knew it could get crazy fast, so I kept my hands on the wheel and stayed very still. Turns out a vehicle matching the description of my old truck had been involved in an armed robbery of a hotel. They weren't interested in me at all. Especially, when they discovered I was alone in the truck and female.

                My advice would be (and it is worth exactly what you paid for it): Don't play lawyer - we don't give a rip, and for the most part, cops aren't particularly fond of lawyers. Be polite - a few manners and respect goes a long way. You don't need to tell us your life story - we don't care about that either. Lord, there were times I wished people would just shut up! People lie to cops more than they tell the truth. We know that. If you at least acted a bit remorseful for speeding or whatever and didn't have a negative driving history, chances were you wouldn't get anything but a warning.

                  all of my experiences with LEO's are great.. even when I was in the wrong...

                  I was cruising about 85mph when I was 19. A Camaro pulled alongside me and could hear the engine despite my own engine noise and Pantera on my radio playing No Good Attack the Radical...... I took it as an invite.

                  I punched it. Apparently the Camaro was a built car also. Kind of pissed me off. I still had 2 car lengths ahead of it... We went about 2 miles when I decided that I was done playing. This was my track car, and I took it to a party where I was playing DD for my drunk buddy. I figured a hot car could help me ditch my drunk buddy and get me a hot girl.. not how that happened (ironic I know)...

                  I was going 145 when the red and blues turned on inside the windshield and grill.

                  Apparently it was close to the end of the state troopers shift, and if he did in fact write me up for it I was going to jail, my car impounded.. my life over because even though I was underage and sober, my friend was underage and drunk.

                  so......... he asked me to pop the hood.

                  Everything since then has involved my foster children and other kids that need help in a hurry while PS and other agencies get involved. When it's a kid it's usually a 3 minute wait time for a LEO to show up.... If it's somebody shining deer in the corn field it may take 20 or 30 minutes..... But they are always there for me when it's life and death... and my experiences with them is to always give it to them straight.

                  Now for my bad analogy..... 99% of the population are sheep. 1% are wolves..... even if a LEO is born a sheep, he can be trained to be a wolf.... and wolves have a killer instinct.. and a nose for who is trying to pull some bravo sierra over on them.

                    Let's all be careful about the name callings.

                    Ben Franklin once said "We must, indeed, all hang together, or assuredly we shall all hang separately." And from the attitudes I've seen recently, we are starting to hang seperately. The anti-gun establishment is causing us to fight amoung ourselves and they are doing a damn fine job of it. Gun Rights groups versus manufacturers that are fighting for rights, hunters versus the self defense crowd, civilians versus LEO.

                    The infighting will surely hang us all since we cannot stand together in this fight. There are more than enough pro-2A LEOs, .gov and .mil folks out there trying to help behind the scenes. Plenty of Sheriffs, Deputies, local LEO and even State Police working against the agenda currently going on. Plenty of manufacturers expending major capital trying to get the insanity stopped.

                    I mean for crying out loud, even the Attorney General is starting to come down on local LEO and stating charges will be filed if they get in the way of gun grabbers. And we still cannot stand together and fight this? We still have the attitudes of "us versus them?" We judge an entire group on the actions of the few? Cops, just like every job out there, is a snapshot of society. There are great ones, good ones and not so good ones. But somehow the "not so good ones" tend to spoil it for everyone. All get lumped into the same category by some of you.

                    Surely we will hang separately if we cannot get over our differences long enough to fight the big battles that are currently being fought in our State Capitals and in Washington. This is something we HAVE to take a stand on and we MUST win. For our children and grandchildren, we must win this. For the soul of our nation, this is a fight we cannot lose and we must stand together to win.
                    Experience is a cruel teacher, gives the exam first and then the lesson.

                      Can I get an amen!!!

                      Folks, as I have said numerous times on here-

                      Their is a HUGE underground of .mil and LEO that are NOT going to go along with the establishment's program. And I'm not just talking about "Oathkeepers." I'm talking about essentially an underground guerrilla movement within these ranks. Most will remain hidden until the time, some after. They will be the ones that are quietly preparing, putting assets in the right place now.

                      The "powers that be" KNOW THIS, and they FEAR these types of people. I've met some of them, if you heard the saying "we are everywhere", well I'm not sure they didn't come up with that.

                      They will do a lot of damage on the inside if/when things go bad, whole companies will sit at base because their loyalty to "just follow orders" will be in question. The quislings that are not loyal to the Constitution they will quietly take care of- one will go out on a patrol with them and be steered towards an IED, they will be lost in action, etc. As one of them told me "we will clean our own house." If you could see the determination in that man's eyes when he said that! I would hate to be some boot licking quisling that was "just following orders" when this guy's crew got a hold of them.

                      Men like that are TRUE AMERICANS, loyal to the CONSTITUTION over a "job."

                      This is not conjecture, this is not a work of fiction, this is first hand experience meeting with, training with and helping types like this prepare, these men are serious. The establishments KNOWS this, and they FEAR them.

                      They ARE everywhere. For the upteenth time- let's not dishearten them by the constant "leo's and .mil suck" type of talk. I get sick of hearing it and I'm neither one. Unknowing, you are pissing off one of our greatest sets of allies.

                            and i'm not leo or mil

                              This, get to know your local Sheriff, deputies and city/town police. They are people just like anyone else. Shoot, the Sheriff you should know best since it's an elected position.

                              But remember, these are the same folks that are a few doors down on your block, have kids in the same school as your kids, buy groceries in the same stores as you do...they are all around you.

                              Chances are, you might have met one or two of them around and didn't realize it. But getting to know them on a personal level means you can make an unbiased decision on whether you think they are good or bad. Wouldn't advice shooting at any of them no matter what lol.
