  • 2nd Gun Ownership

How many of you know that if you legally shoot a, certified blood leaching, zombie just as he is going to deliver the fatal scratch to your inferior human body, in your own bedroom, that Officer Friendly, while patting you on the back and telling you "nice group", is going to take your gun and log it into evidence until the DA determines that indeed it is a justified shooting?

How many of you also know that this is common knowledge among criminals? Just as they troll the papers and T.V. for funerals to rob houses they look for opportunities such as this where you are "taken" for questioning and returned empty handed and psychologically distressed.

How long would it take the DA in your crowded, high homicide rate city, even if on the other side of the county or as in our case where some DAs have several counties, to make a decision?

Having a "friend" who is willing to bring you another firearm, or defend you if you are mentally unable, for your immediate defense, once you have completed your questioning at the station and leave the parking lot is a good "Prep".

Even if the DA determines that indeed it is a justified shooting, you still won't get your gun back. Trust me, I know. I was told, I would have to get a attorney, go to court to get my gun back, even though I was found not guilty. Here's the thing! Your going to have to pay a attorney atleast $1500 to get your gun back, now if you shot him with a $3000 custom Wilson Combat 1911, yea I would go to court, but my gun wasn't worth $1500. It's a bunch of bureaucratic BS! No, I didn't shoot anyone! lol! It was a false charge by my exwife brought on me 15 years ago.

Time for a little personal experience here. I loaned a 12 guage riot gun to my son for home protection. He was living in a shaky area, and I thought it was appropriate. One afternoon, he got a knock on the front door. He has learned not to open the door, and yelled, "Who is it?" The voice came back and asked for Carmen, or some other name he didn't recognize. He told them she wasn't there. They left, and he got the shotgun out. About five minutes later, the back door was kicked in, and four black men came toward the living room with the leader holding his pistol gangsta style, up by his head. My son grabbed the shotgun and popped off a round, taking a chunk of drywall about four inches from the leader's head. My son said all he saw after that was a vapor trail as they four that came in beat feet getting out of there. The cops showed up, (after a few minutes to make sure the shooting had stopped). They found the perps, (easy enough; look for the pale-faced African-American with a load in his drawers) and took my son in for questioning. I went over and sat on the house while he was gone.

The cops did two things: The first thing they did was to get a search warrant. Obviously, the only reason anyone gets kicked in is because they're dealing drugs, right? They didn't find any, but they searched the house anyway. The second thing was that they took the shotgun, held it as "evidence," and it took TWO YEARS to get it back. When I did get it back, there was rust on the barrel and the shell sock that was on the stock was gone. Oh, I should mention that the guys who kicked in were out of jail by the time I got the shotgun back. My son had moved since then.

He later learned that the leader of the pack was the brother of his next door neighbor. She blamed my son for her brother getting arrested, and went into his house and took water from the aquarium and poured it over all of his furniture. No proof, of course, but he knows who did it. Yes, I thought of several appropriate retaliations, but didn't do any of them, as I avoid drama if at all possible. The furniture was old anyway, and mostly from Salvation Army, so it wasn't a major loss.

Being a former-LEO, I can attest to these statements and many more. The guns were either held due to money issues, or trial dates. Even if the trials were over, you still had to hold them until cases were closed and appeals were done and over with. I can say that police evidence lockers hold some seriously impressive weaponry. Also unlinke popular belief, CSI takes quite some time to do their thing.

I never graduated from the police academy due to reasons of my own (basically if I ended up firing my weapon in the line of duty- I would be off of work w/o pay, pay for my own lawyer, and then after the decision of the courts I could be re-imbursed for my pay and lawyer fees) Needless to say, I was not impressed and also I would have to work for 3 years before I cold get vacation. Small department and several of the LEO's hadn't had a vacation in a while....
